HOW WAS ABRIL CAPTURED? Abril was captured near the Edgewood Apartment Homes in Rocklin. According to Rocklin police dispatch audio, Abril was found in the middle of the creek between the Edgewood Apartment Homes and Zion Court. The Placer County Sheriff’s Office said Abril was still wearing belly chains and was in jail-issued underwear when he was captured. Video of the arrest shows what appears to be Abril shirtless being placed into a Placer County sheriff’s vehicle while being surrounded by nearly a dozen officers.Bill Sanchez, a homeowner on Zion Court, said he tipped off law enforcement to Abril’s location.He told KCRA’s Lysée Mitri he went into his backyard to take his dog out about noon and saw an orange jumpsuit laying on the ground. He then noticed someone crouched down in the water at the creek nearby.Sanchez said he then returned to his home and called Rocklin police.“I said, ‘We’ve got the guy,’” Sanchez said.Police arrived within minutes and found the suspect in the creek where the man surrendered, he said.The sheriff's office told KCRA 3 around 5:30 p.m. that Abril was back at the South Placer County Jail in Roseville after he was checked out at the hospital.Jail records show that Abril is now facing a felony charge for escaping from jail. His new court date for that charge has not yet been listed.HOW DID ABRIL GO MISSING? WHY WAS HE AT THE HOSPITAL? A report released by the sheriff's office on Sept. 1 said that Abril was taken to Sutter Roseville Medical Center to be treated for "possible seizure activity" and was being monitored on rotating shifts by a single deputy at a time.Around 2:58 a.m. the morning of July 9, Abril had managed to slip out of his only cuff on his right hand. He then ran out of the room, downstairs and out an emergency exit.A social media post by the Placer County Sheriff's Office said the deputy had used the restroom inside the hospital room without ensuring Abril was properly restrained.“During the time of Abril’s initial flight, the deputy’s attention was distracted but he was almost immediately able to give chase,” the report said.The deputy was not able to locate or apprehend Abril for several minutes before calling for additional law enforcement resources.WHERE WAS ABRIL SPOTTED AFTER HIS ESCAPE? Law enforcement initially focused their search in the eastern Roseville and Rocklin areas of Placer County. More than 70 law enforcement personnel from various agencies were involved in the manhunt. Abril was spotted Sunday around 3:39 a.m. on video surveillance near Rainer Court in Rocklin and then walking to Saddletree Lane. KCRA 3 obtained two surveillance videos from the Rocklin neighborhood showing Abril soon after he was believed to have escaped. WHY WAS ONLY ONE DEPUTY ASSIGNED TO GUARD SOMEONE CHARGED WITH MURDER? Sheriff Woo said the procedure for the number of guards assigned to an inmate during a hospital stay depends on the inmate's jail classification status. According to the Placer County Inmate Rulebook, classification determines where an inmate is housed.That determination is made based on various factors, including:Current behavior and attitudeChargesPast criminal historyPast behavior while in prior custodyA classification interview that’s supposed to happen with a classification officerA conference with probation or parole officersAbril was initially designated as a "two-officer" inmate due to his charges, but staffing and his behavior in the facility downgraded him to "one-officer.""This unfortunately led to the unintended result that when it came time for his transportation and supervision in the hospital, his downgraded classification status was determinative in the decision of how many deputies to utilize," the report said.The report recommends that the one- or two-person classification inside a facility should not be used to decide how many officers escort an inmate outside the facility."Classification based on conduct within the facility should have very little to do with the determination of how many officers should transport an inmate outside the facility," the report said.He’s facing multiple felony charges including murder, attempted murder, using a person as a shield, and firearms charges. He also has a lengthy criminal history in California in San Luis Obispo County and Santa Clara County.IS THE DEPUTY ASSIGNED TO GUARD ABRIL STILL WITH THE DEPARTMENT? When KCRA 3 first asked, a spokesperson for the department could not say if the deputy assigned to watch Abril has been interviewed yet by the department.“Each deputy and officer has due process that we are legally required to follow and there is a process that goes along with that,” Angela Musallam, the department’s public information officer, said in an email to KCRA 3.According to the sheriff, that deputy is still employed with the department and is on active duty."I don't know what actions the deputy did or did not do that could have violated policy or not, but I can assure this community that if policies were violated, appropriate disciplinary action will be taken," Sheriff Woo said.WILL ABRIL’S ESCAPE FROM CUSTODY BE A DIFFERENT CASE? No, on Sept. 19, a judge approved the motion to combine both Abril’s homicide and “escape from custody” cases. Abril’s next court date is scheduled for February 2024.DOES ABRIL HAVE A CRIMINAL HISTORY? Yes. Abril previously served a six-year sentence in San Luis Obispo County for intimidating/threatening witnesses and burglary in 2014.In 2008, he was charged with larceny, burglary and control of deadly weapons in Santa Clara County.He was being investigated in connection with a freeway shooting before the hostage situation. WHERE DID THE APRIL SHOOTOUT HAPPEN?The shooting happened in Roseville near Mahany Park on Pleasant Grove Boulevard. HOW DID THE SHOOTOUT AND HOSTAGE SITUATION BEGIN? California Highway Patrol officers were in the area of Mahany Park to serve a search warrant on Abril’s vehicle and residence in connection to a Sacramento County freeway shooting. It is also unclear where the home is located. The Roseville Police Department said officers planned to make contact with Abril at Mahany Park. WHAT LED TO THE SUSPECT TAKING HOSTAGES? One officer was shot while CHP served the search warrant. He has since been identified as Matthew Hiatt. CHP officers there returned gunfire, officials said.Six CHP officers were involved in the initial confrontation, Roseville police said.The Roseville Police Department responded to the scene to help after the CHP officer was shot, and another gunbattle happened between Roseville and CHP officers, and the gunman. Overall, Roseville police said Abril shot 15 to 20 rounds at officers and the victims. CHP officers fired 15 to 25 rounds at Abril, and Roseville police fired 6 rounds, officials said.It’s unclear how many officers shot their weapons.Abril took two bystanders hostage, Roseville police said. The video also appears to show him firing a shot toward her arm.The video shows Abril eventually walking out of the creek while using the woman as a shield. When she stumbles, he raises his arms and surrenders to officers who take him into custody.Throughout the video, a dog also stays near Abril’s side. According to law enforcement scanner traffic from that day, Abril was originally observed near the dog park with two dogs following him to the creek.The drone video also appears to show officers performing life-saving measures on James MacEgan near a cluster of trees along the creek.
